Terms of Service

Last Updated: June 13, 2026 • Read carefully before deploying virtual instances, dedicated servers, or colocation equipment.

1. Acceptance of Terms

Welcome to Singinn Data Center. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client" or "User") and Singinn Software Pvt. Ltd. ("Singinn", "we", "us", or "our"), governing your acquisition, access, deployment, and use of all servers, Cloud VPS, bare metal infrastructure, colocation hosting spaces, DDOS scrubbing networks, and management tools.

By purchasing any service, signing up on our portal at portal.singinn.in, or configuring servers on our network, you signify that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, and Service Level Agreement (SLA).

2. Services & Deployments

We agree to provide the infrastructure resources provisioned in your order form. Specifically:

  • Provisioning SLAs: Cloud VPS are provisioned dynamically within 30 to 90 seconds. Dedicated and Bare Metal servers are deployed within 2 to 4 hours, subject to hardware availability.
  • IP Allocation: All allocated IP addresses remain the sole intellectual property of Singinn or our upstream registries. We reserve the right to change, recall, or re-route IP allocations for security or routing optimizations.
  • Infrastructure Maintenance: Scheduled maintenance will be announced at least 48 hours in advance via email. In the event of emergency security patching or hardware failure, we reserve the right to perform immediate hot-swaps or updates.

3. Billing, Payments & Cancellations

Clients are required to maintain active and funded billing configurations:

  • Payment Terms: All recurring plans (Dedicated, VPS, Colocation) are billed on a pre-paid monthly or annual cycles. Invoices are generated 10 days before the due date.
  • Grace Period & Late Fees: Invoices must be paid on or before the due date. A grace period of 3 days is allowed, after which a 10% late fee may be automatically appended to the invoice, and services may face suspension.
  • Refund Policy: Due to the dynamic allocation of bandwidth and hardware assets, dedicated servers and colocation setups are non-refundable. Cloud VPS instances have a 7-day money-back guarantee, excluding third-party licenses (such as cPanel, WHM, Plesk, or Windows OS licenses).
  • Cancellation: Cancellation requests must be submitted directly through our portal at least 5 days prior to the next billing date.

4. Acceptable Use Policy

Singinn infrastructure must be utilized solely for lawful business activities. We maintain a zero-tolerance policy against network abuse and illegal operations. The following practices are strictly prohibited:

  • Hosting or distributing malware, spyware, ransomware, botnets, phishing landing pages, or unlicensed copyrighted materials.
  • Launching outbound DDoS, DoS, brute-force attacks, port scanning, or vulnerability tests against external networks without authorization.
  • Configuring open proxies, unauthenticated mail relays, TOR exit nodes, or public DNS resolvers vulnerable to amplification attacks.
  • Hosting adult content, cryptocurrency mining activities (on CPU/VPS instances), IP spoofing, or sending unsolicited bulk email (SPAM).

5. Client Responsibilities

As a consumer of unmanaged or semi-managed hosting, you agree to maintain the security of your environments:

  • Security Hardening: You are responsible for installing security updates, keeping server operating systems updated, managing local firewall rules, and securing web applications (such as WordPress, custom APIs, etc.).
  • Credentials Security: You must maintain strong passwords and enable Multi-Factor Authentication (MFA) on your client portal account at portal.singinn.in. Singinn is not liable for data loss arising from compromised account credentials.
  • Backups: Unless you subscribe to our dedicated Disaster Recovery (DRaaS) or Daily Backup addon service, backup generation and data restoration are solely your responsibility.

6. Limitation of Liability

Singinn Software Pvt. Ltd. shall not be held liable for any direct, indirect, incidental, special, or consequential damages resulting from server down-times, hardware degradation, data loss, network outages, cyberattacks, or force majeure events.

In all events, our total cumulative liability under this agreement, whether in contract, tort, or warranty, shall not exceed the actual amount paid by the Client to Singinn for the specific service during the one (1) month immediately preceding the event.

7. Suspension & Termination

We reserve the right to restrict or terminate server access under the following conditions:

  • Abuse Suspensions: If our NOC detects outbound spamming, network attacks, or security breaches originating from your server, the server will be suspended immediately to protect network integrity.
  • Non-payment Susensions: If an invoice remains unpaid for 5 days past the due date, all associated services will be suspended. If the invoice remains unpaid for 14 days, the server space, virtual disks, and data will be permanently terminated and deleted from our arrays. Singinn is not responsible for data lost due to non-payment termination.

8. Governing Law & Dispute Resolution

These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India.

Any disputes, claims, or legal proceedings arising out of or in connection with these Terms, service outages, or customer bills shall be subject to the exclusive jurisdiction of the competent courts located in Gurgaon, Haryana, or New Delhi, India.
